Please read these Terms and Conditions ("Terms") carefully before using the ToneLab Generator mobile application (the "App"). By using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes acceptance of the new Terms.

2. Use of the App

ToneLab Generator is provided for personal, non-commercial use only. You agree to:

• Use the App in compliance with all applicable laws and regulations
• Not misuse, copy, modify, distribute, or reverse-engineer the App or its content
• Not use the App for any illegal or unauthorized purpose
• Not attempt to circumvent any security features of the App
• Not use the App in any way that could damage or impair its functionality

You must be at least 13 years old to use this App. If you are under 18, you represent that you have parental or guardian consent to use the App.

3. Intellectual Property

All content, trademarks, logos, and intellectual property in the App are owned by FLX Code Lab or its licensors. This includes but is not limited to:

• App design and user interface
• Source code and software
• Audio generation algorithms
• Graphics, icons, and visual elements
• Documentation and help content

You may not reproduce, distribute, modify, or create derivative works from the App without express written permission from FLX Code Lab.

4. Advertising and Analytics

• The App displays advertisements via Google AdMob. By using the App, you agree to the display of advertisements.
• The App uses Google Firebase Analytics to collect anonymous usage data for app improvement purposes.
• By using the App, you consent to the collection and use of analytics data as described in our Privacy Policy.
• You may manage your ad personalization preferences through your device settings or the consent dialog within the App.

5. User Data and Presets

• Presets you create are stored locally on your device only
• We do not have access to your saved presets or local data
• Uninstalling the App will delete all locally stored data
• You are responsible for backing up any data you wish to preserve

ToneLab Generator is NOT a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

• Binaural beats and audio therapy features are for relaxation and entertainment purposes only
• The App should not be used as a substitute for professional medical advice
• Consult a healthcare professional before using the App if you have:
  • Epilepsy or seizure disorders
  • Hearing impairments or conditions
  • Heart conditions or pacemakers
  • Any other medical conditions that may be affected by audio stimulation
• Do not use binaural beats while driving, operating machinery, or performing tasks requiring full attention

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE
• WARRANTIES REGARDING THE ACCURACY OF FREQUENCY GENERATION
• WARRANTIES THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS

We do not guarantee that frequencies generated are precisely accurate for professional or scientific purposes. For critical applications, use calibrated professional equipment.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLX CODE LAB AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business opportunities, or goodwill
• Personal injury, hearing damage, or property damage resulting from your use of the App
• Any damages arising from third-party services (AdMob, Firebase)
• Any damages exceeding the amount you paid for the App (if any)

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless FLX Code Lab and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Any content you submit or transmit through the App

11. Third-Party Services

• The App uses third-party services including Google AdMob and Firebase, which are subject to their own terms and privacy policies
• We are not responsible for the content, privacy practices, or availability of third-party services
• Your use of third-party services is at your own risk
• Links to third-party websites are provided for convenience only and do not imply endorsement

12. App Updates and Modifications

We reserve the right to:

• Modify, update, or discontinue the App at any time without prior notice
• Change, add, or remove features of the App
• Update these Terms at any time
• Require you to accept updated Terms to continue using the App

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, without prior notice. Upon termination:

• Your right to use the App will immediately cease
• All provisions of these Terms that should survive termination will remain in effect
• You must delete all copies of the App from your devices

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FLX Code Lab is located, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration, except where prohibited by law.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and GDPR Compliance Statement, constitute the entire agreement between you and FLX Code Lab regarding your use of the App, superseding any prior agreements.

17. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by FLX Code Lab.
