Please read these Terms and Conditions ("Terms") carefully before using the Club Card mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Club Card, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Description of Service

Club Card is a digital loyalty card management application that allows you to:

• Store loyalty card information (card numbers, barcodes, names)
• Scan physical card barcodes using your device camera
• Scan barcodes from photos in your device gallery
• Access your cards offline
• Add home screen widgets displaying your cards for quick access
• Customize cards with colors and emoticons for easy identification
• Choose between light, dark, or system theme
• Optionally sync cards across devices via cloud storage
• Share cards with other users

The App is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature at any time.

3. User Eligibility

You must be at least 13 years old to use this App. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

4. User Account and Registration

4.1 No Account Required

You can use Club Card without creating an account. All data will be stored locally on your device.

4.2 Optional Google Sign-In

To enable cloud synchronization, you may sign in using your Google account. By doing so, you agree to Google's Terms of Service and Privacy Policy.

4.3 Account Security

You are responsible for:

• Maintaining the security of your device and Google account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

5. User Responsibilities

You agree to:

• Use the App only for lawful purposes
• Provide accurate information when adding cards
• Not attempt to interfere with the App's functionality
• Not reverse engineer, decompile, or disassemble the App
• Not use the App to violate any third-party rights
• Comply with all applicable laws and regulations

6. Prohibited Activities

You may NOT:

• Share or sell your account access to others
• Use the App for fraudulent purposes
• Create fake or fraudulent loyalty cards
• Attempt to gain unauthorized access to our systems
• Upload viruses, malware, or harmful code
• Harass, abuse, or harm other users
• Share inappropriate content through the card sharing feature
• Use automated systems (bots) to access the App

7. Loyalty Card Data

7.1 Your Data

You retain all rights to the loyalty card information you add to the App. We do not claim ownership of your card data.

7.2 Accuracy

You are responsible for ensuring the accuracy of card information you enter. We are not liable for any issues arising from incorrect or outdated card data.

7.3 Third-Party Cards

Club Card is not affiliated with any loyalty program providers. We simply provide a tool to store and display your existing cards digitally.

8. Card Sharing Feature

8.1 Public Sharing

When you share a card publicly:

• Anyone with the 6-digit share code can import your card
• The card information becomes publicly accessible
• You grant us a license to host and distribute the shared card data

8.2 Inappropriate Content

Do not share cards containing:

• Personal identification numbers (e.g., driver's license, passport)
• Credit card or financial account numbers
• Sensitive personal information
• Illegal or offensive content

We reserve the right to remove any shared cards that violate these terms.

9. Intellectual Property

9.1 Our Rights

Club Card and its original content, features, and functionality are owned by us and protected by international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

9.3 Trademarks

All trademarks, logos, and brand names displayed in the App are the property of their respective owners. Their inclusion does not imply any affiliation or endorsement.

10. Third-Party Services

10.1 Firebase/Google Services

The App uses Firebase for authentication, cloud storage, and analytics. Your use of these services is subject to Google's Terms of Service.

10.2 Google AdMob

The App displays advertisements via Google AdMob. Clicking on ads is subject to the advertiser's terms. We are not responsible for third-party ad content.

10.3 No Endorsement

We do not endorse any third-party services or products advertised in the App.

11. Disclaimers

11.1 "As Is" Service

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability
• Uninterrupted or error-free operation

11.2 No Guarantee of Acceptance

We do not guarantee that stores, businesses, or loyalty programs will accept digital cards displayed in the App. Acceptance is at the discretion of each merchant.

11.3 Data Loss

While we implement backups (via optional cloud sync), we are not responsible for any data loss. We recommend enabling cloud sync and keeping your own backups of important card numbers.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid to use the App (which is $0 for the free version)
• We are not liable for any loss of data, profits, business opportunities, or goodwill
• We are not responsible for any issues arising from third-party services or advertisements

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Club Card, its developers, and affiliates from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any card data you add or share

14. Advertising

The App displays advertisements to support the free service. By using the App, you agree that:

• Ads may be displayed within the App
• We may share usage data with ad networks (see Privacy Policy)
• We are not responsible for ad content or accuracy
• Clicking ads is at your own risk

15. Modifications to the App

We reserve the right to:

• Modify, update, or discontinue any feature
• Change the App's appearance or functionality
• Limit certain features or access
• Perform maintenance or updates

We will provide reasonable notice for material changes when possible.

16. Termination

16.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App
• Deleting your account (if using cloud sync)

16.2 Termination by Us

We may suspend or terminate your access if you:

• Violate these Terms
• Use the App for illegal purposes
• Harm other users or our systems
• Share inappropriate content

16.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• Local data on your device is not automatically deleted
• Cloud-synced data may be deleted after 30 days
• Provisions regarding liability and disputes survive termination

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Italy, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Italy.

18. Dispute Resolution

18.1 Informal Resolution

Before filing any legal claim, please contact us at flxcodelab@gmail.com to attempt informal resolution.

18.2 Arbitration

If informal resolution fails, disputes shall be resolved through binding arbitration, except where prohibited by law.

18.3 Class Action Waiver

To the extent permitted by law, you waive the right to participate in class action lawsuits or class-wide arbitration.

19. Changes to Terms

We may update these Terms from time to time. Changes will be effective when:

• Posted in the App with an updated "Last Updated" date
• For material changes, we'll notify you via in-app notification

Your continued use after changes constitutes acceptance of the new Terms.

20. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Club Card regarding use of the App.
